Legal Responses

Women, children and young people experiencing domestic abuse must be able to access protection and be assured of an appropriate, robust and informed response from all parts of the justice system. This includes the provision of legal advice, representation and access to legal aid. Therefore, a large part of our work involves monitoring of civil and criminal law and policies and procedures implementing the law. This involves looking at the responses of the police, judiciary, courts, prosecutors, solicitors and other agencies. We want to ensure that existing rights and protections, positive responses and good practice are not only safeguarded but are also strengthened and improved.

To achieve this, we proactively engage with, and provide responses to consultations, bills, and proposals for policy change generated by a variety of organisations and bodies, primarily in Scotland but also in Westminster and the EU. As such, we work with the Scottish Government and Parliament, the Crown Office, ACPOS and Scottish police forces, the Law Society of Scotland, Scottish Legal Aid Board, and in partnership with other statutory and voluntary organisations, to ensure that women, children and young people are safe and protected
