- SWA response to Lord Carloway’s Review of criminal law and procedure
- 2011
- Lord Carloway was nominated to lead a review of the criminal law and practice in light of the United Kingdom Supreme Court's decision on a suspect’s right to legal advice after the Cadder case. This Review considered whether there was a need to balance this change with additional reforms and guidance to preserve not only the rights of suspects, but also of victims and witnesses and the wider interests of justice while maintaining an efficient and effective system for the investigation and prosecution of crime. It looked at, amongst other areas, the process of providing legal advice to suspects prior to and during police questioning, and evidence including corroboration and the suspect's right to silence.
